Several attorneys say ABC was smart to settle defamation case
Our take: ABC News and George Stephanopoulos reached a $16 million settlement with President-elect Trump after he sued them for defamation after Stephanopoulos repeatedly and falsely stated Trump had been “found liable for rape” by a civil jury during an interview with South Carolina Congresswoman Nancy Mace. The jury specifically ruled that Trump was liable for sexual assault but not rape.
Several experienced attorneys weighed in on the settlement. The sample from this article unanimously thought the settlement was smart on ABC’s part, as both the facts of the case and the discovery process would have exposed ABC to risk that could have resulted in a much bigger payout after embarrassing details came to light.
It’s hard to believe Stephanopoulos did not know he was making an incorrect statement. An organization like ABC has oodles of producers, fact-checkers, and executives that either should have or did know these facts to make sure they were represented correctly on their show. This same group of people also could have issued a retraction or correction after the errors. They did not. Now they can learn a $16 million lesson.

American’s trust in nations court system at all times low
Our take: In a not surprising poll, Americans' trust in the nation's currency system dropped to a historical low of 35%. The drop was bipartisan, with pollsters citing Republicans likely distrusting the multiple cases against former President Trump and Democrats likely distrusting the Dobbs decision overturning Roe v. Wade and the Supreme Court decision around presidential immunity.
It is disheartening to see these results, but not surprising. Our system of government was set up with three distinct branches. The legislative branch has the power to make laws. The executive branch has the power to enforce laws. The judicial branch is supposed to interpret laws.
The issue with the judicial branch is political activism from the bench. Rather than interpreting the laws as they are written, many judges have taken the law into their own hands, interpreting them to deliver results they believe in rather than what the law states. The Dred Scott case, where the court ruled slaves could not sue in court, essentially rendering slaves non-citizens. Plessey v. Ferguson, where the court delivered its clearly unconstitutional “separate but equal” ruling, and Roe v. Wade, where the court conjured up the constitutional right to abortion from whole cloth, are all cases that many consider egregious cases of judicial activism that harmed millions.
People expect the courts to be fair and interpret the laws fairly as they were written. They have no tolerance for favoritism or partiality. We may not have law degrees, but we know a railroad job when we see one. Until the courts get back to acting impartially and upholding the laws as written, they will not win back the respect and trust of the American people.
